This Acceptable Use Policy (the "AUP") is part of the Terms of Service for the Brimley platform. It sets out the rules that apply to anyone who sends messages through, or otherwise uses, the Service. We enforce it because email is a shared resource — a single bad sender hurts every other sender on the platform, and on the wider internet.
You are the legal sender of every message you dispatch through Brimley. You are responsible for ensuring those messages comply with applicable law and with this AUP.
1. Lawful and ethical use
You must comply with all applicable laws and regulations, including but not limited to:
- The U.S. CAN-SPAM Act;
- Canada's Anti-Spam Legislation (CASL);
- The U.S. Telephone Consumer Protection Act (TCPA);
- The EU and UK GDPR;
- The UK Privacy and Electronic Communications Regulations (PECR);
- Australia's Spam Act 2003;
- Equivalent laws in any other jurisdiction in which you operate or to which you send messages.
You must not use the Service for any purpose governed by the U.S. Fair Credit Reporting Act (FCRA), or to make decisions about a person's eligibility for credit, employment, insurance, housing, or any other legally regulated benefit.
2. B2B only
Brimley is a business-to-business tool. You may only use the Service to contact individuals at their place of work, in connection with their professional role. You must not target individuals in a personal capacity, and you must not contact consumer email addresses (e.g. a personal Gmail address) through Brimley.
3. Identification and headers
Every message you send through Brimley must:
- Use a truthful "From" name and address identifying you or your organisation. You must not impersonate another person or organisation.
- Use an accurate, non-deceptive subject line.
- Include your physical postal address in the body of any commercial message, where required by CAN-SPAM or equivalent.
- Be sent from a domain you control, with valid SPF, DKIM, and DMARC records aligned to that domain.
You must not send through generic group inboxes such as
hello@, info@, marketing@, or
noreply@.
4. Unsubscribe and suppression
Brimley enforces a strong, automatic compliance baseline. By default, every email you send through Brimley:
- Carries an RFC 8058 one-click
List-Unsubscribeheader; - Includes an HTML "Unsubscribe" hyperlink automatically appended to the message body, linking to a tokenised opt-out URL we host on your behalf;
- Adds the recipient to your organisation's suppression list the moment they unsubscribe; subsequent campaigns will skip them automatically.
You must not disable, hide, obscure, or otherwise tamper with the unsubscribe header or link. You must not contact a recipient who has unsubscribed, asked to stop, or otherwise indicated that they do not wish to be contacted, except where the contact is unambiguously unrelated (for example, a contractual notice they have separately consented to). Brimley honours unsubscribe requests within minutes; manual exports of opt-outs must be honoured within 48 hours.
5. Replies and bounces
Brimley automatically halts an active sequence on reply and suppresses recipients whose addresses produce hard bounces. You must not work around these safeguards.
6. Lists and consent
You must have a lawful basis under the recipient's local law for every message you send. You must not use the Service to send to:
- Lists you have purchased, scraped, or otherwise obtained from sources outside the data providers integrated with the Service;
- Recipients in jurisdictions that require prior express consent (e.g. CASL) where you do not have that consent or a valid exemption;
- Recipients who have previously unsubscribed from your messages or who appear on your organisation's suppression list.
7. Volume and reputation
We apply per-mailbox sending caps and warm-up pacing to protect the reputation of your sending domain. You must not attempt to bypass these limits — for example, by rotating between many mailboxes you do not legitimately operate, by aggressively warming throwaway domains, or by automating the creation of accounts to multiply your effective send volume.
8. Prohibited content
You must not use the Service to send messages that:
- Are unlawful, defamatory, threatening, harassing, hateful, or discriminatory;
- Contain malware, ransomware, phishing payloads, or links to such;
- Promote illegal goods or services;
- Violate the intellectual-property or privacy rights of any third party;
- Are sent on behalf of a third party in a way that hides the actual sender (so-called "list rental" or "ghost-sending").
9. Platform abuse
You must not (a) reverse-engineer, decompile, or attempt to derive the source code of the Service; (b) probe, scan, or test the vulnerability of the Service except under a written authorised-testing agreement; or (c) use the Service to build a competing product.
10. Enforcement
We reserve the right to investigate suspected violations of this AUP. Where we reasonably believe a violation has occurred, we may:
- Throttle or pause your sending;
- Add domains or addresses to a platform-wide suppression list;
- Suspend or terminate your account, with or without notice;
- Cooperate with law-enforcement requests as required by law.
Where practicable we will give you advance notice and an opportunity to remediate. Repeated or wilful violations will result in immediate termination.
11. Reporting abuse
